Terms and Conditions
Best of Both Golf & Ski (Best of Both) is a division of Williams Adventures Inc, an incorporated company within the province of British Columbia, Canada. The terms in this document are those in Best of Both's “Terms & Conditions” which can be viewed at www.bestofboth.ca. Best of Both is referred to as the Company for the purposes of the conditions below.
Best of Both is dedicated to providing a world class experience to our clients and do everything within our power to make time spent with us unforgettable. All golf and ski experiences sold are subject to the following conditions:
1. Rates
Typically rates are quoted per person and shown in Canadian currency (CAD). Special events and/or large group experiences may be priced differently. Rates include all amenities as indicated in the reservation. Package price can include scheduled accommodation, transportation, lift tickets, green fees, rental equipment, meals and tour features, as specified in the reservation. All Rates quoted are subject to change with or without notice but are guaranteed once the reservation has been confirmed in writing (letter or email).
2. Payment/Deposit
1. Deposit due to confirm a reservation: 15% of the total price (rounded up to the nearest dollar) is the standard but can be changed at the discretion of Best of Both. Note: Deposits are not refundable.
2. Balance due 8 weeks prior to arrival unless otherwise stated on the reservation.
A deposit must be paid on completion of booking or the full amount if the booking is made within 8 weeks of trip/event start date. The booking is not accepted until the date shown on the confirmation invoice as issued by the Company. The deposit will be returned if the booking is not accepted. Alteration or cancellation by a client of an accepted booking will be subject to the provisions or sections 4 and 5 of these conditions.
3. Balance due is subject to tax in accordance with the Canadian Government and local municipalities. This includes 5% on the services rendered plus any other country, provincial, state and local municipal taxes where applicable. In the event of tax changes by the government, Best of Both will contact the client before collecting the revised tax.
4. Payment is accepted by cheque, wire transfer, Visa, Mastercard, or American Express, unless stated otherwise. Credit card processing is in Canadian dollars (CAD). If pricing is in foreign currency, the exchange rate on the date of payment will be used.
5. We recommend all clients purchase cancellation insurance in the event that they are unable to complete their reserved experience.
3. Invoice
Best of Both Golf & Ski will send confirmation when appropriate deposits have been paid. If the booking is within eight weeks of trip/event start date, then full payment is due. All outstanding amounts must be paid eight weeks before departure unless stated otherwise on the reservation.. The precise date will be shown on the invoice.
4. Changes & Cancellation by the Client
The effective date of change or cancellation is the date that the Company is advised. If the client decides to alter any details after their booking has been accepted by the Company providing we are informed not later than 6 weeks prior to arrival, these will be treated as a change and a $40 administration fee per booking will be charged. However, any changes to a passengers name originally shown in the booking or any alteration requested within 6 weeks of departure may be treated as cancellation.
5. Cancellation by the Company
If the balance of the holiday price is not paid at the prescribed time, the Company reserves the right, after due notice to the client, to cancel the booking. In this event, or the client cancels after the booking is accepted, the deposit will be forfeited. Additionally, if the cancellation occurs for either reason, the following cancellation charges will be payable by the client.
More than 60 days: Deposit Only
60 days or less: 100%
All cancellation notices must be in writing by mail, email, or fax in order to be official. For special events or large groups, this cancellation policy may change due to the nature of the event and reservation deadlines.
6. The Company’s Liability
The Company will provide travel arrangements in accordance with the contract and accepted responsibility for any loss or damage caused by the Company’s employees. The Company will give all reasonable help in resolving any dispute with independent parties. Should the circumstances arise where the client or any member of the client party should suffer personal injury, illness, or death whilst away and having arisen from a situation unconnected with the arrangements made by the Company, we will at our discretion offer advice, guidance and assistance.
7. Force Majeure
The Company accepts no responsibility for and shall not be liable in respect of loss or damage or changes caused by force majeure events such as strikes, riots, political unrest, war hostilities, or threat of war, terrorist activity, industrial disputes, fire, flood, weather problems or similar events beyond its control.
8. Changes by the Company
Whenever possible all changes will be advised to the client without delay. Should these changes be minor, Best of Both will endeavor to make alternative arrangements and the client will be offered a comparable alternative. If the alteration is major, the client will have the option of accepting the alternative arrangements or receiving a full refund. If a major change occurs within 30 days of trip/event start date, the client will be entitled to compensation payment per person on the following scale:
44 - 29 days: $50
28 - l5 days: $75
14 – 0 days: $100
If the client decides to cancel, as a result of a major change, he/she will be refunded all monies paid plus receive the above compensation. A major change to the clients holiday before departure is deemed to involve changes to your CDN departure airport, resort, hotel accommodation or change of flight timings by more than 12 hours.
9. Brochure Description
Every effort has been made to ensure the accuracy of description and information. However, we are not always able to control all components of the holiday arrangements and it is possible that an advertised facility may be withdrawn or changed due to weather conditions, lack of demand or for maintenance, renovations etc. We will advise you if we become aware of a major change.
10. Liability
By making a Best of Both reservation, you, the client, acknowledge the risks involved in vacationing in mountainous areas in summer and/or winter weather conditions. you are aware of the fact that your guide and/or instructor is not infallible and that, under these circumstances, he/she may be confronted with situations which are not fully controllable. Your guide will make every effort to limit your risk however, certain situations may arise which will limit his/her ability to do so. Therefore, his/her duty only consists of limiting the risk to a minimum. You will be required to sign a RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT before being allowed to ski with any of Best of Both's tour packages. You may also have to sign any waivers provided to you by Best of Both's suppliers of activities prior to engaging in those activities. All claims, irrespective of the nationality of the participants, shall be governed in all respects by and interpreted in accordance with the laws of the Province of British Columbia.
11. Insurance
Best of Both recommends that You purchase Insurance for Your reservation. Some types of travel insurance that we recommend are:
1. Medical insurance to cover any potential hospital and ambulance expenses
2. Personal insurance to cover loss of baggage, skis, and personal belongings
It is your responsibility to ensure that the above insurance covers you while you are participating in a Best of Both experience.Your travel agent may be able to advise you of insurance options and arrange for you the appropriate insurance coverage.
12. Right of Refusal
Best of Both reserves the right to refuse a booking for any reason whatsoever. Please note that some activities in a Best of Both experience require a minimum level of personal fitness and physical participation by You. Any pre-existing ailment or illness may disqualify You from an activity. Best of Both's representatives reserve the right to disqualify any person from an activity if he/she deems that person unfit to continue. To avoid disappointment, please notify Best of Both ahead of time of any health conditions, illness and/or physical or mental disability that may interfere with Your ability to participate in an activity. Many activities may be substituted to suit Your individual needs.
13. Acceptance of Risk
You acknowledge that any Best of Both activities may involve personal risk. You must sign and return to Best of Both a liability waiver at the time of Your Arrival Date. Not doing so may result in You not being able to participate in any activity requiring a liability waiver. Best of Both's activity suppliers have their own waivers, which must also be signed prior to engaging in those activities. In most cases, purchase of a lift ticket or payment of green fees is considered acceptance of the risks associated with the activity, hence acceptance of personal liability.
14. Company Policies
Best of Both has made arrangements for the tour services described in all itineraries. The carriers providing transportation services, hotels and other services are independent contractors (the “Suppliers”) and are not the agents, employees of, servants of, or in joint venture with Best of Both.
No person other than a representative of Best of Both authorized by a document in writing may vary, add or waive any of the terms and conditions set forth in the preceding provisions.
